Filing a State Complaint in Georgia

How do you file a state complaint about an IEP violation in Georgia?

Georgia provides a formal state complaint process through the GaDOE Division for Special Education Services and Supports, governed by Ga. Comp. R. & Regs. 160-4-7-.12 and 34 CFR §§300.151-300.153. Any individual or organization may file a written, signed complaint alleging that an LEA or the state has violated a requirement of IDEA. The complaint must be filed within one year of the date of the alleged violation (Ga. Comp. R. & Regs. 160-4-7-.12), which is shorter than the two-year statute of limitations for due process. The complaint must include: the signature and contact information of the complainant; if alleging violations about a specific child, the child's name, address, and school name; a description of the nature of the problem including facts; and a proposed resolution to the extent known. A copy of the complaint must be simultaneously sent to the LEA (superintendent or special education director) at the same time it is filed with GaDOE. The LEA must respond within 10 business days. GaDOE has 60 calendar days to investigate and issue a written decision, though extensions may be granted for exceptional circumstances. The investigation may include on-site visits and document review. The written decision must address each allegation and include findings of fact, conclusions, and reasons for the decision, as well as any corrective actions required. Georgia also offers mediation as a voluntary dispute resolution option, available at no cost to the parties, where a qualified and impartial mediator assists the parties in reaching a legally binding agreement. Mediation discussions are confidential and cannot be used as evidence in subsequent proceedings. Georgia additionally offers Facilitated IEP Team Meetings as a dispute prevention process, where a neutral facilitator from GaDOE joins the IEP meeting to improve communication among team members.
