1. Acceptance of Terms

By creating an account or using IEP Says ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not create an account or use the Service. These terms constitute a legally binding agreement between you and IEP Says.

2. Description of Service

IEP Says is an AI-powered platform that helps parents and legal guardians understand their child's Individualized Education Plan (IEP). The Service provides plain-language summaries, goal analysis, compliance checks, and advocacy tools. IEP Says provides educational information only. Nothing on this platform constitutes legal advice, and use of the Service does not create an attorney-client or advocate-client relationship.

3. Account Registration

You must be at least 18 years of age and a parent or legal guardian of the child whose IEP you are uploading. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Parent/Guardian Representation

By uploading documents to IEP Says, you represent and warrant that you are the parent or legal guardian of the child whose educational records are contained in those documents, and that you have the legal authority to upload, share, and authorize the processing of those records.

5. Acceptable Use

You agree to use IEP Says solely for personal, non-commercial purposes related to understanding your own child's educational documents. You may not: (a) upload documents for children you do not have legal authority over; (b) use the Service for any commercial purpose without written consent; (c) attempt to reverse-engineer, copy, or replicate the analysis framework; (d) use the Service to harass, threaten, or harm any individual or organization; (e) interfere with or disrupt the Service or its infrastructure.

6. Intellectual Property

You retain full ownership of any documents you upload to IEP Says. We claim no ownership rights over your uploaded content. The IEP Says platform, including its analysis framework, scoring methodology, user interface, brand assets, and all associated intellectual property, is owned by IEP Says and protected by applicable copyright and trademark laws.

7. AI-Generated Content

Analysis, summaries, scores, and recommendations generated by IEP Says are produced by artificial intelligence and may contain errors, omissions, or inaccuracies. All AI-generated content is provided for informational purposes only. You should always verify AI-generated information against your original IEP document and consult with your child's IEP team or a qualified professional for clarification on any discrepancies.

8. Payment Terms

IEP Says offers a one-time Analysis Pass for $59.99. Re-running an analysis on a previously analyzed document costs $9.99. Payment is processed securely by Stripe. All prices are in US dollars and are subject to change with advance notice. Your purchase grants access to a full analysis report for one uploaded IEP document, including all associated tools and features. For details on refunds, please see our Refund Policy.

9. No Guarantee of Outcomes

Use of IEP Says does not guarantee any specific educational outcome, school district compliance, or favorable dispute resolution. Educational outcomes depend on many factors beyond the scope of this Service, including school district policies, state laws, and individual circumstances. For complex legal disputes, due process hearings, or state complaints, we strongly recommend consulting a qualified special education attorney or certified educational advocate.

10. Limitation of Liability

To the maximum extent permitted by applicable law, IEP Says's aggregate liability arising out of or related to your use of the Service shall not exceed the amount you paid for the specific analysis giving rise to the claim. In no event shall IEP Says be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of educational opportunities, or emotional distress, regardless of the cause of action or theory of liability.

11. Indemnification

You agree to indemnify, defend, and hold harmless IEP Says and its founder, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your misuse of the Service; (b) your uploading of documents you are not authorized to share; (c) your violation of these Terms; or (d) your violation of any third party's rights.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any conduct that we determine, in our sole discretion, is harmful to the Service or other users. You may delete your account at any time from the Settings page, which will permanently remove all your data including uploaded documents, analysis results, and child profiles within 30 days.

13. Warranty Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. IEP Says does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

14. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be resolved through good faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, it shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. Claims that qualify for small claims court may be brought in small claims court instead of arbitration. These Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of law provisions.

15. Changes to Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice via email or through the platform before the changes take effect. Your continued use of IEP Says after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service and delete your account.
