IEP Related Services in Idaho
What related services can be included in an IEP in Idaho?
Idaho requires that each IEP specify all related services the student requires to benefit from special education, consistent with IDAPA 08.02.03.110.04 and federal law (34 CFR 300.34). Related services recognized by Idaho include speech-language pathology and audiology services, interpreting services, psychological services, physical therapy, occupational therapy, recreation including therapeutic recreation, counseling services including rehabilitation counseling, orientation and mobility services, school health services, school nurse services, social work services in schools, parent counseling and training, transportation, and assistive technology services. The IEP must specify the projected start date, frequency, location, and duration of each related service. Assistive technology devices and services must be provided if required by the IEP, including use at home when the team determines it is necessary (34 CFR 300.105). Idaho requires that all related service providers be appropriately licensed or certified under Idaho state standards. Districts may contract for related services they cannot provide directly, but all services must be at no cost to the family (Idaho Code § 33-2001).
What Idaho Requires
The IEP must specify each related service with its projected start date, frequency, location, and duration (IDAPA 08.02.03.110.04; 34 CFR 300.320(a)(7)).
Related services include speech-language, audiology, PT, OT, counseling, psychological services, social work, nursing, transportation, recreation, assistive technology, and interpreting services (IDAPA 08.02.03.006; 34 CFR 300.34).
Assistive technology devices and services must be provided as required by the IEP; home use must be considered when the team determines it is necessary for FAPE (34 CFR 300.105).
All related service providers must meet Idaho licensure and certification standards applicable to their profession (IDAPA 08.02.03.018).
Districts may contract for related services they cannot provide directly, but all services must be at no cost to the family (Idaho Code § 33-2001; 34 CFR 300.17).
Key Timelines
Related services must begin on the projected start date in the IEP and be in effect at the beginning of each school year (IDAPA 08.02.03.110.04; 34 CFR 300.323(a)).
Related services must be reviewed at least annually as part of the IEP review (IDAPA 08.02.03.110; 34 CFR 300.324(b)).
For transfer students, comparable services must be provided while a new IEP is being developed (34 CFR 300.323(e)-(f)).
