How do you file a state complaint about an IEP violation in Illinois?

Illinois implements the federal state complaint process under 23 IAC 226.570 and 34 CFR 300.151-153. Any parent, individual, or organization may file a signed, written complaint with the Illinois State Board of Education (ISBE) alleging that a school district, cooperative service unit, or the state itself has violated a requirement of Part B of IDEA, 34 CFR Part 300, Article 14 of the Illinois School Code, or 23 IAC Part 226 (23 IAC 226.570(a)). The complaint must include: a statement of the alleged violation, supporting facts, the complainant's signature and contact information, the names and addresses of the students and schools involved (if known), a description of the nature of the problem, and a proposed resolution if known (23 IAC 226.570(a)). The complaint must allege a violation that occurred not more than one year prior to the date the complaint is received, with limited exceptions under 105 ILCS 5/14-8.02e(b) (23 IAC 226.570(b); 34 CFR 300.153(c)). Use of the official ISBE complaint form is recommended but not required. Complaints may be submitted with physical, electronic, digital, or conformed signatures. Within 60 calendar days of receiving a valid complaint, ISBE must conduct an independent investigation — including on-site visits if necessary — and issue a written decision addressing each allegation with findings of fact, reasoning, and compliance orders as needed (23 IAC 226.570(c)). During the investigation, the complainant may submit additional information orally or in writing, and the school district must provide a written response with a proposed resolution within 45 days. The 60-day timeline may be extended for exceptional circumstances or if both parties agree to attempt mediation (23 IAC 226.570(d)). If a due process hearing is pending on the same issues, those issues are held in abeyance while non-overlapping issues proceed (23 IAC 226.570(e)).
