Transition Age Rights in Kentucky

What are the transition age rights for IEP students in Kentucky?

Kentucky has two distinct transition age thresholds, both earlier than or equal to federal requirements. The first is 8th grade or age 14 — whichever comes first — when the IEP must begin including a statement of transition service needs focusing on the student's course of study (707 KAR 1:320, Section 7(1)). This trigger is Kentucky-specific and may occur before 8th grade if the ARC determines it is appropriate. Importantly, this transition component must be aligned with the student's Individual Learning Plan (ILP) as required by 704 KAR 3:305 — a unique Kentucky requirement that integrates special education transition planning with the general education career planning system required for all Kentucky students. The second threshold is age 16, when the IEP must include measurable postsecondary goals based on age-appropriate transition assessments related to training, education, employment, and independent living, plus the transition services needed to achieve those goals (707 KAR 1:320, Section 7(2)). FAPE in Kentucky extends through age 21 (for students who have not received a regular high school diploma). Educational rights transfer to the student at age 18 unless the student is declared legally incompetent under Kentucky law (KRS Chapter 387), and the IEP must include a rights-transfer notification statement at least one year before the age of majority (707 KAR 1:320, Section 5(14)).

What Kentucky Requires

Transition service needs must be addressed in the IEP beginning in the student's 8th grade year OR at age 14 — whichever comes first — focusing on course of study (707 KAR 1:320, Section 7(1)).

Earlier initiation is permitted if the ARC determines it is appropriate for the individual student (707 KAR 1:320, Section 7(1)).

The 8th grade/age 14 transition component must be aligned with the student's Individual Learning Plan (ILP) required under 704 KAR 3:305 — a Kentucky-specific integration requirement (707 KAR 1:320, Section 7(1)).

Beginning at age 16, measurable postsecondary goals based on transition assessments (training, education, employment, independent living) and the transition services needed to reach them must be included in the IEP (707 KAR 1:320, Section 7(2)).

The student must be invited to any ARC meeting at which transition services are discussed; if absent, the LEA must take other steps to obtain student preferences and interests (707 KAR 1:320, Section 7; 34 CFR 300.321(b)).

At least one year before the age of majority (age 18), the IEP must document that the student has been informed of the rights that will transfer (707 KAR 1:320, Section 5(14)).

FAPE continues through age 21 for students who have not received a high school diploma (707 KAR 1:290, Section 1).
