Transition Age Rights in Maine

What are the transition age rights for IEP students in Maine?

Maine has a distinctive transition age framework. Under 20-A M.R.S. § 7207-B and MUSER Ch. 101 § VIII(7)(a), transition service planning must begin no later than the first IEP in effect when the student turns 14 — making Maine one of the states with the earliest mandatory transition planning age in the country. Beginning at age 14, the IEP must include appropriate measurable postsecondary goals in education/training, employment, and where appropriate, independent living skills, along with transition services needed to reach those goals. At age 17, the IEP must document that the student has been informed of the rights transfer that will occur at age 18. All educational rights transfer to the student at age 18 (20-A M.R.S. § 7207). Students with disabilities in Maine remain eligible for FAPE through age 20 — specifically through the end of the school year in which the student turns 20 — under 20-A M.R.S. § 7203. For early intervention, Part C (birth to age 3) serves children with developmental disabilities; a transition conference must be convened before the child's third birthday to plan for Part B services.

What Maine Requires

Transition planning must begin no later than age 14 — the first IEP in effect when the student turns 14 must include transition goals and services (20-A M.R.S. § 7207-B; MUSER Ch. 101 § VIII(7)(a)).

The IEP must include measurable postsecondary goals in education/training and employment (and independent living where appropriate), based on age-appropriate transition assessments (MUSER Ch. 101 § VIII(7)(a); 34 CFR 300.320(b)).

At age 17, the IEP must document that the student has been informed of the rights transfer that will occur at age 18 (MUSER Ch. 101 § X(9); 34 CFR 300.320(c)).

All educational rights transfer to the student at age 18 unless a legal guardian has been appointed (20-A M.R.S. § 7207; MUSER Ch. 101 § X(9)).

FAPE eligibility in Maine ends at the conclusion of the school year in which the student turns 20 (20-A M.R.S. § 7203).

Early intervention (Part C) students must have a transition conference planned before the child's third birthday to facilitate the move to Part B preschool special education services.
