When does IEP transition planning start in Maine?

Maine requires transition planning beginning at age 14, which is significantly earlier than the federal minimum of age 16 and among the earliest mandated transition ages in the country. Under MUSER Ch. 101 § VIII(7)(a), beginning not later than the first IEP in effect when the student turns 14, the IEP must include appropriate measurable postsecondary goals in education/training, employment, and where appropriate, independent living skills. The IEP must include transition services needed to reach those goals. Maine's age-14 transition requirement is codified in 20-A M.R.S. § 7207-B and MUSER Ch. 101 § VIII(7). Transition services must be coordinated with outside agencies, and with parental consent the SAU must invite outside agency representatives to IEP meetings. At age 17 (one year before the age of majority), the IEP must document that the student has been informed of the transfer of rights that will occur at age 18. Students with disabilities remain eligible for FAPE in Maine through age 20 (inclusive) — meaning through the end of the school year in which the student turns 20, under 20-A M.R.S. § 7203.

What Maine Requires

At age 17, the IEP must document that the student has been informed of the transfer of educational rights that will occur at age 18 (MUSER Ch. 101 § X(9); 34 CFR 300.320(c)).

Students must be invited to their IEP meeting when transition services are discussed; if the student does not attend, the SAU must take other steps to obtain student input (MUSER Ch. 101 § VIII(2); 34 CFR 300.321(b)).
