Mental Health Services in Minnesota IEPs

What mental health services are available through an IEP in Minnesota?

Minnesota addresses mental health services for students with disabilities through both its special education eligibility structure and related services framework. The Emotional or Behavioral Disorders (EBD) category under Minn. R. 3525.1329 captures students with mental health conditions that adversely affect educational performance, requiring documentation of behavior patterns across at least three settings for a minimum of six months. Other Health Disabilities (Minn. R. 3525.1335) may cover students with mental health diagnoses such as anxiety or depression that significantly limit strength, vitality, or alertness. Counseling services and psychological services are recognized related services that may be included in an IEP (34 CFR 300.34). The evaluation process for EBD eligibility under Minn. R. 3525.1329, subp. 3 requires mental health screening as a required component. When behavior impedes learning, the IEP team must consider positive behavioral interventions and supports (Minn. R. 3525.0850; 34 CFR 300.324(a)(2)(i)). Minnesota has also invested in school-based mental health and early childhood mental health programs through state funding under Minn. Stat. § 245.4889 and related statutes, though these operate alongside (not as a replacement for) IDEA special education services. Mental health related services in an IEP must specify frequency, location, and duration (Minn. R. 3525.2810, subp. 1(F)).

Students with mental health diagnoses that limit alertness, vitality, or strength may also qualify under Other Health Disabilities (Minn. R. 3525.1335).

Counseling services and psychological services are recognized related services eligible to be included in an IEP (34 CFR 300.34).

When behavior impedes learning due to mental health concerns, the IEP team must consider positive behavioral interventions, supports, and strategies (Minn. R. 3525.0850; 34 CFR 300.324(a)(2)(i)).

Mental health related services must be specified in the IEP with frequency, location, and duration (Minn. R. 3525.2810, subp. 1(F)).

Key Timelines

Mental health related services must begin on the projected start date in the IEP (Minn. R. 3525.2810, subp. 1(F)).

Services must be reviewed at least annually at the IEP meeting (Minn. R. 3525.3100).
