IEP Transition Services in Mississippi

When does IEP transition planning start in Mississippi?

Mississippi follows the federal IDEA requirement that transition services planning begin no later than the first IEP to be in effect when the student turns 16 (or younger if the IEP team determines it is appropriate) (34 CFR 300.320(b); Miss. Code Ann. § 37-23-11). Mississippi has not enacted a lower age threshold for transition, as some states have. Beginning at age 16, the IEP must include: measurable postsecondary goals in the areas of education or training, employment, and where appropriate, independent living skills; a statement of transition services needed to reach those goals; and a course of study to support movement toward postsecondary goals. Transition services in Mississippi must be based on age-appropriate transition assessments. The IEP must invite the student to any meeting at which transition services will be discussed, and must invite outside agency representatives when appropriate and with consent (34 CFR 300.321(b)). Mississippi's IDEA-B transition requirements align with federal law; the state has no unique above-baseline transition mandate. Students are eligible for FAPE through age 21 in Mississippi (Miss. Code Ann. § 37-23-3). Educational rights transfer to the student at age 18.
