Filing a State Complaint in Missouri
How do you file a state complaint about an IEP violation in Missouri?
Missouri's state complaint procedures are called 'child complaints' and are managed by the Missouri Department of Elementary and Secondary Education (DESE), Office of Special Education. Any individual or organization may file a child complaint with DESE alleging that a school district or other public agency has violated IDEA or the Missouri State Plan for Special Education. The complaint must allege a violation that occurred not more than one year prior to the date the complaint is received — this is shorter than the two-year lookback for due process complaints, which is a separate dispute resolution mechanism. DESE must investigate and resolve the child complaint within 60 calendar days of receipt, unless the Commissioner of Education grants an extension for exceptional circumstances or both parties agree to extend the timeline. DESE assigns a staff member to investigate, determines whether an onsite visit or phone interviews are needed, and issues a written finding. If DESE finds a violation, it can order corrective actions. Missouri also offers mediation and facilitated IEP (FIEP) as voluntary, no-cost dispute resolution options. Child complaint decisions from DESE are separate from due process hearing decisions issued by the Administrative Hearing Commission.
What Missouri Requires
Any individual or organization may file a child complaint with DESE's Office of Special Education alleging that a school district or public agency violated IDEA or the Missouri State Plan (34 CFR 300.153; Missouri State Plan, Regulation V).
