How are IEP services delivered in Montana?

Montana has a unique service delivery infrastructure driven by its rural geography. Special education cooperatives, governed by ARM 10.16.39 (ARM 10.16.3901 through 10.16.3904) and ARM 10.16.26 (older provisions), allow school districts to pool resources to hire specialized staff—such as speech-language pathologists, occupational therapists, and physical therapists—who travel among member districts. Cooperatives receive 5% of the total state special education allocation for travel and administration costs, plus 17.5% of the allocation provided for the related services block grant (MCA § 20-7-431 et seq.). Montana has cooperative boundaries defined by ARM 10.16.3809, and districts belong to designated cooperatives. Under MCA § 20-7-411, Montana LEAs can fulfill their FAPE obligation through direct programs, cooperative arrangements, regional services, or contracted providers. The IEP must specify the location where each service will be provided (34 CFR 300.320(a)(7)), and LRE placement decisions must be made in accordance with 34 CFR 300.114 through 300.118 (ARM 10.16.3340). Residential placements in state psychiatric hospitals or residential treatment facilities (defined in MCA § 20-7-436) are governed by ARM 10.16.3341, which requires IEP development, LEA notification, parental rights protections, and FAPE assurance.
