Filing a State Complaint in Montana

How do you file a state complaint about an IEP violation in Montana?

Montana's state complaint process for special education violations is governed by ARM 10.16.3661 (Opportunity to Present Complaints) and ARM 10.16.3662 (State Complaint Procedures). Any organization or individual may file a written complaint with the OPI Dispute Resolution Office alleging a violation of any provision of IDEA Part B or its implementing state regulations. Complaints must be filed with the OPI Dispute Resolution Office (P.O. Box 202501, Helena, MT 59620-2501) and must include the name and address of the school, a description of the violation, the facts supporting the allegation, and a proposed resolution. Complaints must allege violations that occurred not more than one year prior to the date of filing. Montana's process includes an Early Assistance Program (EAP) (ARM 10.16.3660), which is an informal, non-adversarial dispute resolution service administered by the OPI Legal Division. After a complaint is filed, the EAP has 15 business days to attempt informal resolution—these 15 days fall within but outside the 60-day investigation timeline. If the EAP cannot resolve the complaint within 15 days, the responding party has 10 days to submit a written response. The OPI must issue a final written report within 60 calendar days (extendable for exceptional circumstances), addressing each allegation with findings of fact, conclusions of law, and any required corrective action. There is no right to appeal a final complaint report. Non-compliance may result in withholding of state or federal funds or changes to accreditation status.
