What IEP accommodations are available in Nebraska?

Nebraska IEPs must specify all accommodations that enable the student with a disability to access the general curriculum and participate in assessments. Under 92 NAC 51-007.06D, the IEP must include a statement of supplementary aids and services and program modifications or supports for school personnel to support the student in regular education settings. For state and districtwide assessments, including the Nebraska State Accountability (NeSA) tests, the IEP must specify any individual appropriate accommodations (92 NAC 51-007.06F). If the student will take an alternate assessment (the Nebraska Alternative Assessment Program, NAAP), the IEP must explain why the student cannot participate in regular assessments and which alternate assessment is appropriate (92 NAC 51-007.06F). Accommodations must be provided at no cost to the family as part of FAPE (Neb. Rev. Stat. § 79-1119). All teachers and service providers must be informed of their specific responsibilities for implementing accommodations (34 CFR 300.323(d)).

What Nebraska Requires

Key Timelines

Accommodations must be in effect at the beginning of each school year and as soon as possible after the IEP is developed (34 CFR 300.323(a)).

IEP accommodations must be reviewed at least annually and revised as needed (92 NAC 51-007.09; Neb. Rev. Stat. § 79-1129).

Progress on the effectiveness of accommodations is reviewed through periodic progress reports at least as frequently as report cards (92 NAC 51-007.06C).
