IEP Evaluation Process in New Mexico
How long does New Mexico have to complete an IEP evaluation?
New Mexico's evaluation requirements are governed by NMAC 6.31.2.10 and 34 CFR 300.301–300.311. The key New Mexico-specific provision is that the initial evaluation and written evaluation report must be completed within 60 calendar days of receiving written parental consent — this is one of the most precisely tracked compliance indicators (Indicator 11) in the state's IDEA monitoring system (6.31.2.10 NMAC). New Mexico LEAs must respond to a parent's written evaluation request within 15 school days of receipt, or within 30 calendar days if the request arrives near an extended school break (6.31.2.10 NMAC). Following completion of the evaluation, the eligibility determination meeting must be convened within 15 school days, and parents must receive the written evaluation report at least two calendar days before this meeting (6.31.2.10 NMAC). All evaluations must be comprehensive, using a variety of assessment tools and strategies across all areas of suspected disability; no single measure may serve as the sole criterion (6.31.2.10 NMAC; 34 CFR 300.304). New Mexico requires that evaluations of culturally and linguistically diverse learners occur in the child's native language and use non-discriminatory methods and materials; assessors must ensure evaluations reflect aptitude rather than language differences (6.31.2.10 NMAC). Reevaluations must occur at least every three years unless parents and the LEA agree it is unnecessary; they may also occur more frequently if conditions warrant or if requested by a parent or teacher (6.31.2.10 NMAC; 34 CFR 300.303). New Mexico also requires that reading teachers and school administrators receive training in research-based reading interventions prior to special education referral, and that special education teachers receive specialized reading instruction training for dyslexic students (6.31.2.9 NMAC).
