How are IEP services delivered in New Mexico?

New Mexico requires that IEPs specify the location, frequency, duration, and projected start date for each special education and related service, consistent with 34 CFR 300.320(a)(7) and NMAC 6.31.2.11. Services must be provided in the least restrictive environment (LRE), meaning that children with disabilities should be educated with nondisabled peers to the maximum extent appropriate, and removal from the general education setting occurs only when the nature or severity of the disability is such that education in general classes with supplementary aids and services cannot be achieved satisfactorily (6.31.2.11 NMAC; 34 CFR 300.114). New Mexico maintains a continuum of alternative placements including general education with supports, resource rooms, self-contained classrooms, special schools, home instruction, and hospital/institution settings (34 CFR 300.115). State-supported educational programs operated by the New Mexico School for the Deaf (NMSD) and the New Mexico School for the Blind and Visually Impaired (NMSBVI) are available as placement options on the continuum for eligible students. Services provided in a student's home district, including charter schools, must follow the same FAPE and LRE requirements as traditional public schools (6.31.2.11 NMAC). For students in juvenile detention or residential treatment facilities, FAPE must be provided; residential facilities must obtain the student's educational records within two business days, and the student cannot remain in an out-of-home program longer than 10 days without receiving special education services (6.31.2.11 NMAC). Extended School Year (ESY) services must be provided if the IEP team determines they are necessary to prevent substantial regression and recoupment difficulties; determination is based on data collected throughout the school year (6.31.2.11 NMAC; 34 CFR 300.106).
