How do you file a state complaint about an IEP violation in Oregon?

Oregon parents and other interested parties may file a formal special education complaint with the Oregon Department of Education when they believe a school district or other educational agency has violated federal special education law (IDEA) or related state rules (ORS 343.041; OAR 581-015). Complaints are directed to ODE's Dispute Resolution office at ode.disputeresolution@ode.oregon.gov. A complaint must be a written, signed statement alleging that a school district, ESD, or other educational agency has violated a specific requirement of IDEA. The complainant must send a copy to the school district at the same time it is filed with ODE. Consistent with federal requirements, ODE must resolve the complaint within 60 calendar days of receipt (34 CFR 300.152; OAR 581-015). ODE investigates through its general supervision function under ORS 343.041. Corrective action orders are issued when violations are found. ODE maintains public Complaint Order Logs tracking all complaints filed since 2008 and associated orders.
