Mental Health Services in Pennsylvania IEPs

What mental health services are available through an IEP in Pennsylvania?

Pennsylvania IEPs may include a range of mental health-related related services — including counseling services, psychological services, and social work services in schools — when those services are required to assist the student in benefiting from special education (34 CFR 300.34(a); 22 Pa. Code §14.103). These services are identified and documented by the IEP team and must specify frequency, location, and duration in the IEP. Pennsylvania's School-Based Access Program (SBAP) is a Medical Assistance (Medicaid) program administered by the Department of Human Services (DHS), with the Pennsylvania Department of Education (PDE) managing IDEA compliance and fiscal disbursements; it allows school districts and intermediate units to bill Medicaid for IEP-mandated health-related services — including psychological, counseling, and social work services — provided to Medicaid-enrolled students under age 21. For SBAP billing, the IEP must specify the amount, frequency, and duration of each service; services without those details are not reimbursable. Psychological services must be provided by a PDE-certified school psychologist. Pennsylvania also facilitates interagency collaboration between PDE and DHS through the Behavioral Health and Children's Services systems, including mobile mental health teams and school-based behavioral health programs supported through county behavioral health managed care organizations.

What Pennsylvania Requires

Mental health-related services — counseling, psychological services, social work — are related services that must be included in the IEP when necessary for the student to benefit from special education (34 CFR 300.34(a); 22 Pa. Code §14.103)

IEP must specify the type, frequency, location, and duration of each related service including mental health services (34 CFR 300.320(a)(4))

Pennsylvania's SBAP — a Medical Assistance program administered by DHS with PDE managing IDEA compliance — allows LEAs and IUs to bill Medicaid for IEP-mandated health and mental health services provided to MA-enrolled students under age 21 (SBAP guidelines)

For SBAP Medicaid reimbursement, the IEP must document specific amount, frequency, and duration of each covered service (SBAP Medical Necessity guidelines)

Psychological services under SBAP must be delivered by a PDE-certified school psychologist (SBAP credentialing requirements)

DHS and PDE maintain interagency coordination to align school-based behavioral health with community mental health services through county behavioral health managed care organizations

IEP team must consider whether a student's emotional or behavioral needs require mental health-related services as part of the IEP planning process (22 Pa. Code §14.133(a))

Key Timelines

Mental health related services begin on the projected start date documented in the IEP and must be implemented no later than 10 school days after IEP completion (22 Pa. Code §14.131(a)(6))

IEP must be reviewed at least annually to assess whether mental health related services remain appropriate or should be added, modified, or discontinued (34 CFR 300.324(b))
