What disability categories qualify for an IEP in Rhode Island?

Rhode Island recognizes the 13 federal disability categories established under IDEA, implemented through 200-RICR-20-10-1.4. The categories are: (1) Autism; (2) Deaf-Blindness; (3) Deafness; (4) Emotional Disturbance (Rhode Island uses the federal terminology); (5) Hearing Impairment; (6) Intellectual Disability; (7) Multiple Disabilities; (8) Orthopedic Impairment; (9) Other Health Impairment; (10) Specific Learning Disability; (11) Speech or Language Impairment; (12) Traumatic Brain Injury; and (13) Visual Impairment Including Blindness. Rhode Island does not use state-specific terminology for disability categories, aligning directly with federal IDEA category definitions. For SLD eligibility, Rhode Island permits both the ability-achievement discrepancy model and the response to intervention (RTI)/multi-tiered system of supports (MTSS) model, as well as a research-based alternative model (200-RICR-20-10-1.4(D); 34 CFR 300.307). Developmental delay is available as a category for students ages 3 through 7, or through age 9 if the district and parents agree (200-RICR-20-10-1.4(C); 34 CFR 300.111(b)).

What Rhode Island Requires

Rhode Island recognizes all 13 IDEA federal disability categories and uses federal terminology without state-specific renaming (200-RICR-20-10-1.4; 34 CFR 300.8).

For SLD eligibility, Rhode Island permits use of the discrepancy model, response to intervention (RTI/MTSS), or a research-based alternative model (200-RICR-20-10-1.4(D); 34 CFR 300.307).

Developmental Delay (DD) is available as a category for students ages 3 through age 7 (or up to age 9 if the district and parent agree) who experience delays in physical, cognitive, communication, social-emotional, or adaptive development (200-RICR-20-10-1.4(C); 34 CFR 300.111(b)).

A student may not be found eligible based solely on a lack of appropriate instruction in reading or math, or on limited English proficiency (200-RICR-20-10-1.4(B); 34 CFR 300.306(b)).

Each disability category has specific evaluation criteria; the multidisciplinary team must document that the student meets all criteria for the identified category (200-RICR-20-10-1.4).

Key Timelines

Initial eligibility determination must be completed within 60 calendar days of parental consent for evaluation (200-RICR-20-10-1.4(A); R.I. Gen. Laws § 16-24-4).

Reevaluation to confirm continued eligibility must occur at least every three years unless parent and district agree it is unnecessary (200-RICR-20-10-1.4(E); 34 CFR 300.303(b)).

Reevaluation may occur more frequently if conditions warrant, but not more than once a year unless the parent and district agree (34 CFR 300.303(b)).
