What are the transition age rights for IEP students in Tennessee?
Tennessee begins required transition services at age 14 — significantly earlier than the federal IDEA baseline of age 16. Under Tenn. Comp. R. & Regs. 0520-01-09-.12(2)(b)-(c), the IEP must include appropriate measurable postsecondary goals based on age-appropriate transition assessments and the transition services and courses of study needed, in the first IEP in effect when the student turns fourteen (14) years old. This is a clear Tennessee-specific requirement that exceeds the federal minimum. All special education related rights vest in the child when the child attains eighteen (18) years of age, per Tenn. What Tennessee Requires
Mandatory transition requirements must be included in the IEP beginning no later than the first IEP in effect when the student turns 14 (Tenn. Comp. R. & Regs. 0520-01-09-.12(2)(b)-(c)) — Tennessee begins 2 years earlier than the federal requirement of age 16.
The IEP must include measurable postsecondary goals based on age-appropriate transition assessments related to education/training, employment, and, where appropriate, independent living skills (Tenn. Comp. R. & Regs. 0520-01-09-.12(2)(b)).
The IEP must include courses of study, transition services, and annual IEP goals reasonably enabling the student to meet the postsecondary goals (Tenn. Comp. R. & Regs. 0520-01-09-.12(2)(c)).
The student must be invited to IEP meetings where transition is being discussed; if the student cannot attend, the LEA must take steps to ensure the student's preferences and interests are considered (34 CFR 300.321(b)).
All special education related rights vest in the child at age 18 (Tenn. Comp. R. & Regs. 0520-01-09-.21).
FAPE continues for children who reach age 22 during the school year, allowing students who need additional transition supports to remain eligible after age 18 (Tenn. Comp. R. & Regs. 0520-01-09-.02(3)).
