What are your rights as a parent in the IEP process in Texas?
Texas provides robust parent rights in the special education process, combining federal IDEA protections with state-specific enhancements. Under TEC §29.005, the ARD Committee must be established before a child is enrolled in special education, and the school district must take steps to ensure one or both parents are present at each ARD committee meeting or are afforded the opportunity to participate (19 TAC §89.1050(d)). Parents must receive written notice of ARD meetings at least five school days before the meeting, unless the parent agrees to a shorter timeframe (19 TAC §89.1050(d)). The notice must be in the parent's native language or other mode of communication. If parents cannot attend in person, the district must allow participation through telephone calls or video conferencing (19 TAC §89.1050(d); 34 CFR 300.322). The district must also provide the Parent's Guide to the ARD Process at least five school days before the initial ARD meeting (TEC §26.0081(b)(1)). Under TEC §29.005(d), if the parent is unable to speak English and the parent's native language is Spanish, the district must provide a written copy or audio recording of the IEP translated into Spanish. For other non-English languages, the district must make a good faith effort to provide a translated written or audio copy. Texas is an all-party consent state for audio recording under TX Penal Code §16.02, which prohibits recording oral communications without the consent of all parties. Both parents and school personnel may record ARD meetings, but all participants must consent before recording begins — one party cannot secretly record the meeting. The IEP document must document the decisions of the ARD committee regarding issues discussed at each meeting (TEC §29.005(c)). Parents have the right to consent before initial evaluation (34 CFR 300.300(a)), consent before initial provision of services (34 CFR 300.300(b)), and revoke consent for continued special education services at any time (34 CFR 300.300(b)(4)). When the ARD committee cannot reach mutual agreement on the IEP, the parent who disagrees must be offered a single opportunity to recess and reconvene, with the reconvened meeting occurring within 10 school days unless mutually agreed otherwise (19 TAC §89.1055(p)(1)). If agreement still cannot be reached, each disagreeing member is entitled to include a statement of disagreement in the IEP (19 TAC §89.1055(p)(1)). The PDSES program, renamed from SSES under SB 2304 (88th Legislature, 2023), empowers parents to direct supplemental special education services and materials for their children (TEC §§29.041-29.049; 19 TAC §102.1601).
