What qualifies a child for an IEP in Utah?

Utah's special education eligibility determination is governed by Utah Admin. Code R277-750-201 and corresponding eligibility criteria sections. A student is eligible for special education and related services when: (1) the student meets the criteria for one or more of Utah's recognized disability categories; (2) the disability adversely affects educational performance; and (3) the student needs special education and related services because of the disability. Utah adopts the standard federal exclusionary factors: a student may not be found eligible if the primary determinant factor is lack of appropriate instruction in reading or mathematics, limited English proficiency, visual, hearing, or motor disabilities (if assessed under another category), or environmental, cultural, or economic disadvantage (34 CFR 300.306(b)). For Specific Learning Disability, Utah Admin. Code R277-750 permits either a severe discrepancy model or a response to intervention (RTI/MTSS) approach. For the Developmental Delay category, Utah allows eligibility from age 3 through age 8. Each disability category has its own eligibility criteria that must be fully documented in the evaluation report. The IEP team — including individuals who can interpret evaluation results — makes the eligibility determination, with parents as equal members.

What Utah Requires

Eligibility requires: (1) a qualifying Utah disability category, (2) adverse effect on educational performance, and (3) need for special education and related services (Utah Admin. Code R277-750-201; 34 CFR 300.306).

A student may not be found eligible if the primary determinant is lack of instruction in reading/math, limited English proficiency, or environmental/cultural/economic disadvantage (34 CFR 300.306(b)).

For SLD, Utah allows eligibility through either a severe discrepancy model between intellectual ability and academic achievement, or an RTI/MTSS process demonstrating inadequate response to evidence-based interventions (Utah Admin. Code R277-750-201; 34 CFR 300.307).

Developmental Delay eligibility is available in Utah for children ages 3 through 8 with delays in physical, cognitive, communication, social/emotional, or adaptive development (Utah Admin. Code R277-750-201; 34 CFR 300.8(b)).

Eligibility determination must be based on multiple data sources; no single assessment or procedure may serve as the sole criterion (Utah Admin. Code R277-750-301; 34 CFR 300.306(c)).

Written notice of the eligibility determination, including the basis for the decision, must be provided to parents (Utah Admin. Code R277-750-401; 34 CFR 300.503).

Key Timelines

Initial evaluation and eligibility determination must be completed within 45 school days of parental consent (USBE Special Education Rules II.D.2.a; Utah Admin. Code R277-750-301).

Developmental Delay eligibility ends at age 9 in Utah; reevaluation under a categorical disability may be conducted before that birthday (Utah Admin. Code R277-750-201).

Reevaluation for continued eligibility must occur at least every three years, or sooner when requested (Utah Admin. Code R277-750-301; 34 CFR 300.303).
