What are the transition age rights for IEP students in Utah?

Utah requires transition planning to begin no later than the first IEP in effect when the student turns 14 — exceeding the federal IDEA minimum of age 16 (34 CFR 300.320(b)) — as established in USBE Special Education Rules III.H.2 and Utah Admin. Code R277-750-201. Transition planning may begin even earlier when the IEP team determines it is appropriate. At age 18, all educational rights transfer from parents to the student unless a legal guardian has been appointed, and the IEP must document that the student has been informed of this transfer (34 CFR 300.320(c)). Students with disabilities remain eligible for FAPE in Utah through the end of the school year in which they turn 22, or until they graduate with a regular high school diploma, whichever comes first (Utah Code § 53G-6-402). A certificate of completion or certificate of achievement does not constitute a regular diploma and does not terminate FAPE eligibility. For Part C early intervention students transitioning to Part B, a transition conference must be convened at least 90 days before the child's third birthday (34 CFR 300.124). What Utah Requires
