Filing a State Complaint in West Virginia

How do you file a state complaint about an IEP violation in West Virginia?

West Virginia parents may file a state complaint with the WVDE Office of Special Education when they believe an LEA has violated IDEA or W. Va. C.S.R. § 126-16. The WVDE must resolve state complaints within 60 calendar days of receipt, unless exceptional circumstances warrant an extension (W. Va. C.S.R. § 126-16-13; 34 CFR 300.152). Complaints may allege violations affecting an individual student or a class of students and must be filed within one year of the alleged violation. The WVDE will conduct an independent investigation, provide both parties the opportunity to submit information, and issue a written decision with corrective actions and timelines if a violation is found. Separate from the state complaint, parents may request mediation or due process (see due_process topic). The WVDE Special Education Ombudsman can assist parents in understanding their rights and the complaint process. Parents may also file a complaint with the U.S. Department of Education's Office for Civil Rights (OCR) for disability discrimination under Section 504 and Title II of the ADA.
