What qualifies a child for an IEP in Wisconsin?
Wisconsin's special education eligibility determination is governed by Wis. Stat. § 115.782 and the disability-specific criteria in Wis. Admin. Code PI 11.36. A child ages 3 to 21 who has not graduated with a regular diploma is eligible when: (1) the child meets the criteria for one or more of Wisconsin's disability categories under PI 11.36; (2) the disability adversely affects educational performance; and (3) the child needs special education. Eligibility cannot be based on lack of appropriate reading or math instruction or limited English proficiency. The IEP team, after reviewing existing data and conducting any necessary additional evaluations, makes the eligibility determination. Wisconsin's evaluation standards under Wis. Admin. Code PI 11.35 direct the team to first determine whether regular education adaptations could address the student's needs before declaring special education eligibility. For SLD, Wisconsin mandates an RtI model with a documented 1.25 SD achievement threshold; the ability-achievement discrepancy model is restricted to private school students only (Wis. Admin. Code PI 11.36(6)). Wisconsin also permits a 'pattern of strengths and weaknesses' approach as an alternative to RtI for SLD under PI 11.36(6).
What Wisconsin Requires
Eligibility requires: (1) meeting criteria for a Wisconsin disability category under PI 11.36; (2) adverse effect on educational performance; and (3) need for special education (Wis. Stat. § 115.76(5)(a); Wis. Admin. Code PI 11.36).
A child may not be found eligible if the determinant factor is lack of appropriate instruction in reading or math, or limited English proficiency (Wis. Stat. § 115.782).
The IEP team must first consider whether regular education modifications and adaptations can address the student's needs before determining special education eligibility (Wis. Admin. Code PI 11.35).
For SLD, Wisconsin requires RtI documentation — documented inadequate achievement (≥1.25 SD below mean after intensive evidence-based interventions) — or a pattern of strengths and weaknesses approach; the ability-achievement discrepancy model is available only for private school students (Wis. Admin. Code PI 11.36(6)).
Evaluation must use multiple tools across all suspected disability areas; no single assessment tool may be the sole basis for eligibility (Wis. Stat. § 115.782; 34 CFR 300.304).
Written prior written notice of the eligibility determination and procedural safeguards must be provided to parents (Wis. Stat. § 115.792).
Key Timelines
Initial evaluation completion: within 60 days of parental consent for evaluation (Wis. Stat. § 115.78(3)).
IEP meeting and placement: within 30 days of the eligibility determination (Wis. Stat. § 115.78(3)).
Triennial reevaluation: at least every three years (Wis. Stat. § 115.782; 34 CFR 300.303).
