How do you file a state complaint about an IEP violation in Alaska?
Alaska provides a state complaint process through the Department of Education and Early Development (DEED) as required by 34 CFR 300.151-153 and implemented under 4 AAC 52.460. Any individual or organization may file a written complaint alleging that a district has violated IDEA requirements. Complaints must be filed with DEED within one year of the alleged violation. DEED must investigate the complaint and issue a written decision within 60 calendar days (4 AAC 52.460(d)). If a violation is found, DEED must order corrective action and, where appropriate, require the district to provide compensatory services. Complaints filed at DEED and due process hearings may be addressed simultaneously, but DEED will delay complaint resolution for issues already pending in due process. What Alaska Requires
