Behavior Supports and BIPs in Idaho
How do behavior supports work in a Idaho IEP?
Idaho's IEP team must consider positive behavioral interventions and supports when a student's behavior impedes learning, consistent with IDAPA 08.02.03.110 and 34 CFR 300.324(a)(2)(i). When a student's behavior impedes the student's learning or the learning of others, the IEP team must consider positive behavioral interventions and supports and other strategies to address the behavior. Idaho's restraint and seclusion regulations (IDAPA 08.02.03.200 through 08.02.03.250) require that physical intervention be preceded by positive behavioral supports in non-emergency situations. Functional behavioral assessments (FBA) are a recognized tool in Idaho's special education framework; while Idaho does not make an FBA a prerequisite for all restrictive procedures in the same manner as some states, FBAs are required in the context of manifestation determinations and are best practice before developing behavior intervention plans. When a student with a disability is removed from the current placement for more than 10 school days for disciplinary reasons, or when a pattern of removals constitutes a change of placement, an FBA must be conducted and a behavior intervention plan (BIP) must be developed or reviewed (IDAPA 08.02.03.145; 34 CFR 300.530(f)).
What Idaho Requires
When a student's behavior impedes the student's or others' learning, the IEP team must consider positive behavioral interventions, supports, and strategies (IDAPA 08.02.03.110; 34 CFR 300.324(a)(2)(i)).
When a manifestation determination finds the behavior is a manifestation of the disability, an FBA must be conducted and a BIP developed or reviewed (IDAPA 08.02.03.145; 34 CFR 300.530(f)).
Physical intervention (restraint) and seclusion may only be used when a student's behavior poses an imminent physical danger; positive behavior supports must be used in non-emergency situations (IDAPA 08.02.03.200 et seq.).
Behavior intervention plans must be aligned with FBA data and must be reviewed when behavior escalates or does not improve (IDAPA 08.02.03.110; 34 CFR 300.324(b)(1)(ii)).
Any behavior intervention plan (BIP) is incorporated into the IEP and must specify the positive behavioral strategies and supports the student will receive (IDAPA 08.02.03.110; 34 CFR 300.324(a)(2)(i)).
Key Timelines
FBA must be conducted when a manifestation determination is required and behavior is found to be a manifestation of the disability; BIP must be developed or reviewed within 10 school days (IDAPA 08.02.03.145; 34 CFR 300.530(f)).
