What qualifies a child for an IEP in Idaho?

Idaho's special education eligibility determination is governed by IDAPA 08.02.03.096 and the individual disability category rules (IDAPA 08.02.03.082-095). A student is eligible when: (1) the student meets criteria for one or more Idaho disability categories; (2) the disability adversely affects educational performance; and (3) the student needs special education and related services (IDAPA 08.02.03.096; 34 CFR 300.8). Idaho cannot find a student eligible if the determinant factor is lack of appropriate instruction in reading or math or limited English proficiency (IDAPA 08.02.03.096; 34 CFR 300.306(b)). For Specific Learning Disability, Idaho allows two determination pathways: (1) a severe discrepancy between intellectual ability and achievement; or (2) an inadequate rate of learning/response to scientific research-based intervention (RTI/problem-solving model) (IDAPA 08.02.03.091; 34 CFR 300.307-300.311). Developmental Delay may be used as an eligibility category for children ages 3 through 9 to allow early intervention without requiring a specific disability label (IDAPA 08.02.03.095). The eligibility determination must be made by a group of qualified professionals and the parent, and must be based on a variety of evaluation data (IDAPA 08.02.03.096-097).

What Idaho Requires

Eligibility requires: (1) a qualifying Idaho disability category, (2) adverse effect on educational performance, and (3) need for special education and related services (IDAPA 08.02.03.096; 34 CFR 300.8).

Developmental Delay is an available category for ages 3-9, allowing identification of young children who do not yet meet criteria for a specific disability category (IDAPA 08.02.03.095; 34 CFR 300.8(b)).

The eligibility group must include qualified professionals and the parent; no single assessment may be the sole criterion (IDAPA 08.02.03.096-097; 34 CFR 300.306).

For SLD, the evaluation must include an observation of the student in the routine classroom environment and documentation of the student's academic performance (IDAPA 08.02.03.100; 34 CFR 300.310).

Key Timelines

Initial evaluation must be completed within 60 calendar days of receiving parental consent for evaluation (IDAPA 08.02.03.097.01; 34 CFR 300.301(c)(1)).

Developmental Delay category applies through age 9; by age 10, a specific disability category must support continued eligibility (IDAPA 08.02.03.095).

Reevaluation must occur at least every three years unless parent and district agree it is unnecessary, or sooner when conditions warrant (IDAPA 08.02.03.097.02; 34 CFR 300.303).
