How long does Idaho have to complete an IEP evaluation?

Idaho evaluation procedures are governed by IDAPA 08.02.03.097-08.02.03.101. Districts must conduct a full and individual initial evaluation before providing special education services, and informed parental consent is required before any initial evaluation — a district cannot override written parental refusal (IDAPA 08.02.03.097.01; 34 CFR 300.300). Idaho's critical evaluation timeline is 60 calendar days from the date of receiving parental consent for evaluation (IDAPA 08.02.03.097.01; 34 CFR 300.301(c)(1)). Evaluations must use a variety of technically sound assessment tools and strategies and must not rely on any single procedure as the sole criterion. Assessments must be non-discriminatory, conducted in the student's primary language, and administered by qualified personnel. The student must be evaluated in all areas related to the suspected disability. Evaluation reports must document the findings, conclusions about disability eligibility, and the basis for the determination. Reevaluations are required at least every three years or sooner when conditions warrant or parents or teachers request (IDAPA 08.02.03.097.02). For SLD determinations, additional procedures apply, including classroom observation and documentation of the student's academic performance (IDAPA 08.02.03.100; 34 CFR 300.310).
