Transition Age Rights in Idaho
What are the transition age rights for IEP students in Idaho?
Idaho's transition age framework follows the federal IDEA standard. Under IDAPA 08.02.03.110.08 and 34 CFR 300.320(c), when a student with a disability reaches age 18 (Idaho's age of majority), the IEP must document that the student has been informed that educational rights will transfer to them at age 18 unless a legal guardian has been court-appointed. All parental rights and educational decision-making authority transfer to the student at age 18. Students with disabilities remain eligible for FAPE in Idaho through age 21 (Idaho Code § 33-2001; 34 CFR 300.102(a)(3)). Transition service planning begins at age 16 (or younger if the IEP team determines it is appropriate) under IDAPA 08.02.03.110.07, consistent with the federal minimum — Idaho does not have a lower mandatory transition age. Transition planning covers postsecondary education and training, employment, and independent living skills. Early intervention students (Part C, birth to age 3) must have a transition conference at least 90 days before the child's third birthday to plan the transition from early intervention to Part B preschool special education (IDAPA 08.02.03.071; 34 CFR 300.124). Idaho does not have a state-specific expanded transition age below 16.
What Idaho Requires
At age 18, all educational rights and decision-making authority transfer to the student unless a legal guardian has been court-appointed (IDAPA 08.02.03.110.08; 34 CFR 300.520).
The IEP must document that the student has been informed of this rights transfer before the student's 18th birthday (IDAPA 08.02.03.110.08; 34 CFR 300.320(c)).
Transition service planning begins at age 16 (or younger if appropriate); Idaho follows the federal minimum and does not mandate an earlier start age (IDAPA 08.02.03.110.07; 34 CFR 300.320(b)).
Students with disabilities remain eligible for FAPE through age 21 in Idaho (Idaho Code § 33-2001; 34 CFR 300.102(a)(3)).
Early intervention students must have a Part C to Part B transition conference at least 90 days before their third birthday (IDAPA 08.02.03.071; 34 CFR 300.124).
Students must be invited to IEP meetings when transition services will be discussed; if the student does not attend, the district must take other steps to include the student's preferences and interests (IDAPA 08.02.03.109; 34 CFR 300.321(b)).
