IEP Evaluation Process in Iowa

How long does Iowa have to complete an IEP evaluation?

Iowa's evaluation procedures are governed by 281 IAC 41.300–41.320 and implement IDEA Part B requirements. Iowa AEAs conduct most initial evaluations and reevaluations, with LEA personnel participating as needed (Iowa Code § 256B.4; Iowa Code § 273.1). Evaluations must use a variety of tools and strategies to gather functional, developmental, and academic information; no single measure may be the sole criterion (281 IAC 41.305; 34 CFR 300.304). Iowa uses a non-categorical, performance-domain framework: evaluators assess up to eight performance domains to determine whether a disability adversely affects educational performance. Iowa must complete the evaluation and determination within 60 calendar days from written parental consent (281 IAC 41.301). For SLD, Iowa requires the systematic problem-solving process — documentation of the student's response (or lack thereof) to evidence-based interventions in general education is central to the SLD determination (281 IAC 41.307; 281 IAC 41.313). Written parental consent is required before the initial evaluation and before each reevaluation (unless the LEA/AEA can demonstrate the parent has been notified and has not responded). Evaluations must be conducted by qualified examiners in the student's native language or other mode of communication (281 IAC 41.305; 34 CFR 300.304). What Iowa Requires

Iowa AEAs conduct most initial evaluations and reevaluations; the AEA-LEA team must include individuals qualified to evaluate in each area of suspected disability (Iowa Code § 256B.4; Iowa Code § 273.1; 281 IAC 41.305).

Evaluations must use a variety of assessment tools and strategies; no single assessment may be the sole criterion for determining eligibility (281 IAC 41.305; 34 CFR 300.304(b)).

Evaluations must be conducted in the student's native language or other mode of communication and must be free from racial, cultural, and linguistic bias (281 IAC 41.305; 34 CFR 300.304(c)).

For SLD, the systematic problem-solving process is required — evaluators must document that despite evidence-based interventions in general education, the student did not make adequate progress (281 IAC 41.307; 281 IAC 41.313).

Written parental consent is required before the initial evaluation and before each reevaluation; parents may revoke consent for continued services at any time (281 IAC 41.300; 34 CFR 300.300).

Reevaluations must occur at least every three years and may be conducted without additional data collection if the team determines existing data are sufficient (281 IAC 41.303; 34 CFR 300.303).

The evaluation must include an assessment of all eight performance domains in which the student may have a disability (281 IAC 41.306; Iowa DOE Eligibility Standards).

Key Timelines

Evaluation and eligibility determination must be completed within 60 calendar days from the date of written parental consent (281 IAC 41.301; 34 CFR 300.301(c)(1)).

The evaluation team must contact all team members including parents to schedule the eligibility meeting prior to the 60-day deadline (Iowa DOE guidance; 281 IAC 41.301).

Reevaluation must occur at minimum every three years; however it may not occur more than once per year without parent and LEA/AEA agreement (281 IAC 41.303; 34 CFR 300.303).

Initial IEP must be developed within 30 calendar days of the eligibility determination (281 IAC 41.323; 34 CFR 300.323(c)).
