IEP Evaluation Process in Nebraska
How long does Nebraska have to complete an IEP evaluation?
Nebraska evaluation procedures are governed by 92 NAC 51-007.01 through 51-007.04 and Neb. Rev. Stat. § 79-1135. Districts must conduct a full and individual initial evaluation before providing special education services, and informed parental consent is required before any evaluation (92 NAC 51-007.01A; Neb. Rev. Stat. § 79-1132). Nebraska has a specific 60-calendar-day timeline for completing initial evaluations from the date of receiving parental consent for evaluation — this is a calendar-day standard, not a school-day standard (Neb. Rev. Stat. § 79-1135; 92 NAC 51-007.01A). Evaluations must use a variety of tools and strategies, must not rely on any single procedure as the sole criterion, must be non-discriminatory, and must be conducted in the student's native language (92 NAC 51-007.02; 34 CFR 300.304). The student must be assessed in all areas of suspected disability. Evaluation reports must summarize performance, document disability category or continued eligibility, document present performance levels and educational needs, and indicate whether special education services are needed (92 NAC 51-007.04). Reevaluations are required at least every three years, or sooner when conditions warrant or when requested (92 NAC 51-007.01B).
What Nebraska Requires
Parental consent is required before conducting any initial evaluation; the district cannot override a refusal to evaluate (92 NAC 51-007.01A; Neb. Rev. Stat. § 79-1132; 34 CFR 300.300).
Nebraska requires evaluation to be completed within 60 calendar days of receiving parental consent — this is a calendar-day, not school-day, timeline (Neb. Rev. Stat. § 79-1135; 92 NAC 51-007.01A).
Evaluations must use a variety of tools and strategies; no single procedure may serve as the sole criterion for eligibility (92 NAC 51-007.02; 34 CFR 300.304(b)).
Assessments must be non-discriminatory on racial and cultural bases and administered in the student's native language (92 NAC 51-007.02; 34 CFR 300.304(c)).
Evaluation reports must include a summary of results, disability category documentation, present performance levels, educational needs, and service recommendations (92 NAC 51-007.04).
For SLD evaluations, the team must document whether the student was provided appropriate instruction in regular education and include data-based progress monitoring information (92 NAC 51-007.03B; 34 CFR 300.309(b)).
Key Timelines
Initial evaluation must be completed within 60 calendar days of receiving parental consent (Neb. Rev. Stat. § 79-1135; 92 NAC 51-007.01A).
Parental consent for evaluation is distinct from consent for placement — these are separate consent steps (92 NAC 51-007.01A; 34 CFR 300.300).
Reevaluation must occur at least once every three years, or sooner when conditions warrant or parents/teachers request it (92 NAC 51-007.01B; 34 CFR 300.303).
When the IEP team determines no additional evaluation data are needed, parents must be notified and informed of their right to request evaluation (34 CFR 300.305(d); 92 NAC 51-007.01B).
