How are IEP services delivered in Nebraska?

Nebraska Rule 51 governs service delivery settings and the full continuum of placement options. Under 92 NAC 51-006, the continuum of alternative placements must include instruction in regular classes, special classes, special schools, home instruction, and instruction in hospitals and institutions, plus supplementary services such as resource rooms and itinerant instruction. Extended school year (ESY) services must be provided when the IEP team determines the student requires them to receive FAPE (92 NAC 51-007.10); the determination cannot be based solely on the category of disability or administrative convenience. Districts must make available the full continuum of service delivery options. The IEP must specify the frequency, location, duration, and projected start date for all services (92 NAC 51-007.06G). Nebraska Rule 51 requires that all staff responsible for implementing the IEP have access to the IEP and understand their specific responsibilities (34 CFR 300.323(d)). Districts may contract for specialized services they cannot directly deliver, subject to all Rule 51 quality requirements.
