IEP Transition Services in Nebraska

When does IEP transition planning start in Nebraska?

Nebraska requires transition planning beginning at age 16 (or earlier if the IEP team determines it appropriate), consistent with 92 NAC 51-007.06H and Neb. Rev. Stat. § 79-1129. The IEP must include appropriate measurable postsecondary goals based on age-appropriate transition assessments in the areas of training, education, employment, and, where appropriate, independent living skills; a statement of the transition services needed to assist the student in reaching those goals; and, beginning at age 16, a statement of any interagency responsibilities or linkages. The IEP must also include the courses of study needed to assist the student in reaching postsecondary goals. Nebraska's transition framework aligns with the federal IDEA baseline (34 CFR 300.320(b)). At age 18, educational rights transfer to the student unless a guardian has been appointed, and the IEP must document that this transfer has been communicated (Neb. Rev. Stat. § 79-1152). Students with disabilities are eligible for FAPE in Nebraska through age 21 (Neb. Rev. Stat. § 79-1113).

What Nebraska Requires

Beginning no later than age 16 (or earlier if appropriate), the IEP must include appropriate measurable postsecondary goals in training, education, and employment based on age-appropriate transition assessments (92 NAC 51-007.06H; Neb. Rev. Stat. § 79-1129; 34 CFR 300.320(b)).

The IEP must include a statement of transition services, courses of study, and any interagency responsibilities or linkages needed to assist the student in reaching postsecondary goals (92 NAC 51-007.06H; 34 CFR 300.320(b)).

When transition services will be discussed, the student must be invited to the IEP meeting; if the student does not attend, the district must take other steps to obtain student input (34 CFR 300.321(b)).

If an agency other than the district fails to provide agreed-upon transition services, the district must convene the IEP team to identify alternative strategies (34 CFR 300.324(c)).

At age 18, the IEP must document that the student has been informed of the transfer of educational rights (Neb. Rev. Stat. § 79-1152).
