IEP Evaluation Process in Vermont

How long does Vermont have to complete an IEP evaluation?

Vermont evaluation procedures are governed by Rule 2362.2 (Evaluation and Eligibility Determination Procedures) and 16 V.S.A. § 2942. Districts must conduct a full and individual initial evaluation before providing special education services, and informed written parental consent is required before any evaluation (Rule 2362.2.1; 34 CFR 300.300). Vermont has a unique 15-calendar-day referral response timeline: within 15 calendar days of receiving a referral for evaluation, the LEA must either request parental consent to initiate the evaluation, convene an Evaluation Planning Team (EPT) meeting to develop an evaluation plan, or provide written reasons for denial of the request (Rule 2362.2.1). Vermont's evaluation completion timeline is 60 calendar days from written parental consent — a state-established calendar-day standard that begins from the date written consent is received by the LEA (Rule 2362.2.1). Evaluations must use a variety of tools and strategies, must not rely on any single procedure as the sole criterion, must be non-discriminatory on a racial or cultural basis, and must be conducted in the student's native language or mode of communication (Rule 2362.2.1; 34 CFR 300.304). The student must be evaluated in all areas of suspected disability. Vermont permits SLD identification through both discrepancy and RTI/MTSS pathways under Rule 2362.2.3. The EPT under Rule 2362.2.2 must include qualified professionals who can interpret evaluation data and make eligibility determinations. Evaluation reports must summarize results, document the disability category, describe present performance levels, and recommend services. Reevaluations are required at least every three years (Rule 2362.2.8; 34 CFR 300.303) and may not occur more than once per year unless parents and the district agree (34 CFR 300.303(b)).

What Vermont Requires
