How are IEP services delivered in Nevada?

Nevada has specific regulations governing service delivery settings, class-size limits, and placement. The full continuum of placement options under NAC 388.270 must be available, including instruction in regular classes, resource rooms, special classes, special schools, home instruction, and hospital settings. NAC 388.150 establishes maximum class-size limits for special education programs organized by disability category — for example, capping class sizes for students with severe disabilities — to ensure individualized instruction. Extended school year (ESY) services must be provided when the IEP team determines the student requires them to receive FAPE; ESY eligibility cannot be limited by category of disability or administrative convenience (34 CFR 300.106). Nevada charter schools authorized by the State Public Charter School Authority (SPCSA) must ensure FAPE is available to all students with disabilities within their programs and are subject to the same NAC 388 requirements as school districts.
