Filing a State Complaint in Nevada

How do you file a state complaint about an IEP violation in Nevada?

Nevada's state complaint process is administered by the Nevada Department of Education (NDE) Office of Dispute Resolution, implementing 34 CFR 300.151-300.153. Any individual or organization may file a written state complaint with NDE alleging that a school district or other public agency has violated federal or state special education requirements. Complaints must be filed within one year of the alleged violation. NDE must investigate and issue a final written decision within 60 calendar days of receiving the complaint, unless the timeline is extended by agreement for mediation or for exceptional circumstances. NDE's decision must address each allegation, include findings of fact and conclusions, and if noncompliance is found, specify required corrective actions and a timeline for completion. NDE's Office of Dispute Resolution also offers IEP facilitation, mediation, and due process hearing services. Nevada's parent rights guides are available in English and Spanish through the NDE and Nevada PEP (Nevada's Parent Training and Information Center).
